How do they get away with it???
How can someone start-up a business selling the same product, using someone else’s brand name, and logo!
Check this out… These are counterfeits!
And how is it different from this? This is the REAL company.
They even copied the Coach logo on their site. It’s amazing to me that they can stay in business. I read that counterfeits cost the US economy over $200 billion per year! Amazing. It is highly illegal. The only way some of these guys get away with it, is if they say, “Just like Oakley” or “Compare to Oakley” Funny how the above site is TOTALLY using the Coach name, and logo!
I don’t get it. With copyright laws, trademarks, and patents. What do businesses really have to protect themselves if anyone can start an “Outlet” and sell fakes cheaper than the “real” guys?
“The federal criminal laws that prohibit any person from trafficking in counterfeit goods and services apply not only to the counterfeiter—the law applies with equal force to any individual or company that knowingly sells a counterfeit product. (18 U.S.C. 2320). This law, known as the Trademark Counterfeiting Act of 1984, carries substantial monetary fines (up to $5 million) and prison time (up to 20 years imprisonment or in some cases life) for individuals and companies who violate the Act.
The Act makes it illegal for any person to intentionally traffic, or attempt to traffic, in goods or services and knowingly use a counterfeit trademark on or in connection (such as product labeling and packaging) with those goods or services.”
I contacted both sites to find out what’s going on here. I have a feeling they are REAL Coach purses, but damaged, previously purchased and returned, or discontinued designs. Either way, I really need to get to the bottom of this.
I received this response from COACH:
“Thank you for bringing your concern to our attention.
The website that you referenced below is not a website that is affiliated with COACH. The only websites online that are authorized COACH websites are COACH.com, Macys.com, Nordstrom.com and Dillards.com.
COACH is aggressively pursuing counterfeiters and uses many methods to protect our brand, our image and most importantly,
our consumers. We apologize for any inconvenience you may have encountered and hope this unfortunate incident will not deter you from purchasing legitimate COACH products in the future. We have passed this information along for review.”
So, I’m hopeful that COACH will investigate these guys and get them shut down, or at least force them to remove their logo from their site. They are clearly breaking the law. Nothing on the site says “LIKE” or “COMPARED TO”. It’s obvious they want people to believe they are the REAL DEAL. Nope. Counterfeit!
